Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PineNutty: Drama English mobile application, website, browser extension, and related services (collectively, the "Service"). The Service is owned and operated by XooPark LLC ("XooPark", "we", "us", or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

PineNutty is an English-learning application offering interactive MicroDramas, vocabulary word feeds, AI-generated stories, quizzes with AI algorithm (including Spaced repetition), graded reading, and related learning tools. We may add, change, or remove features at any time.

2. Eligibility and Accounts

• You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under 18, you must have permission from a parent or legal guardian.
• You are responsible for the accuracy of your account information and for all activity that occurs under your account.
• You must keep your login credentials secure and notify us promptly of any unauthorized use.

3. Subscriptions and Payments

• Parts of the Service are free; other features require a paid subscription.
• Subscriptions purchased through the Apple App Store or Google Play Store are billed and managed by those platforms and are subject to their terms. Cancellations and refunds for those purchases are handled through the respective store.
• Subscriptions purchased on the web are processed by our payment provider (Stripe). You can cancel at any time; access continues until the end of the current billing period.
• Unless otherwise stated, subscriptions renew automatically until cancelled. Your account is charged for renewal within 24 hours before the end of the current period, at the price and for the duration shown at the time of purchase.
• To avoid renewal, cancel at least 24 hours before the end of the current period. For App Store and Google Play purchases, manage or cancel your subscription in your account settings on that store — deleting the app does not cancel a subscription.
• Prices may change with prior notice, effective from the next billing period.

On iOS, the PineNutty app is licensed, not sold, to you, and that license is additionally governed by Apple's Standard End User License Agreement. Where that agreement conflicts with these Terms as to the iOS app license itself, Apple's Standard End User License Agreement governs.

4. PineNuts

PineNuts are a virtual, in-app currency used to unlock and use certain features of the Service. PineNuts have no monetary value, are not your property, cannot be exchanged for cash or transferred outside the Service, and are licensed to you for personal, non-commercial use within the Service only.

• Subscription PineNuts. PineNuts included with a subscription are refreshed at the start of each monthly period. Any unused subscription PineNuts expire at the end of that month and do not carry over to the next period. If your subscription ends, lapses, or is cancelled, any remaining subscription PineNuts expire at the end of the then-current period.
• Purchased PineNuts. PineNuts bought separately through an in-app purchase do not expire and remain available in your account for as long as your account is active and the Service is offered.
• Gift PineNuts. We may also grant PineNuts for free — for example as a sign-up gift, a referral reward, a reward for answering quiz questions correctly, a daily check-in, or a bonus for completing a task or promotion. Gift PineNuts are promotional and are granted at our discretion. Depending on how they were earned, they may expire after a limited period, and limits may apply to how many you can earn or spend in a given day, month, or in total. We may change or withdraw any gift PineNuts at any time.
• When you use PineNuts, we spend the most restricted balance first, to your benefit: expiring gift PineNuts, then subscription PineNuts, then non-expiring gift PineNuts, and finally purchased PineNuts.
• PineNuts that expire, and PineNuts remaining when an account is terminated or deleted, are forfeited and are not refundable or exchangeable. Refunds for in-app purchases are handled by the Apple App Store or Google Play Store under their terms.
• We may change the number of PineNuts granted with a subscription, the price of PineNut packs, the terms of any promotional grant, or the PineNut cost of any feature, with prior notice where required.

5. Referral Program

The Service offers a referral program. Each account is issued a referral code, which a new user can redeem to reward both of you. The program is promotional, is offered at our discretion, and is subject to the following:

• Redeeming a code. A referral code must be redeemed within 24 hours of creating your account. Each account may redeem one referral code, once, and may not redeem its own code.
• The reward. When a code is redeemed, both the referrer and the referred user receive 7 days of Pro access and 500 gift PineNuts. If the referrer already holds a subscription that covers those 7 days, the days would have no effect, so we grant 200 additional PineNuts in their place instead.
• Referral limit. A referrer is rewarded for a maximum of 20 referrals. Beyond that limit the referred user is still rewarded in full, but the referrer receives no further reward.
• Spending limit. PineNuts granted through the referral program may be spent at a rate of no more than 100 PineNuts per day. Any amount above that limit is charged to your other PineNut balances, if you have them.
• Expiry. Referral PineNuts expire 100 days after your most recent referral reward. A new referral extends that date for your whole referral balance. Pro access granted by a referral is not extended by this rule and simply runs out at the end of its term.
• Abuse. We may withhold, reduce, or revoke referral rewards, and suspend or terminate accounts, where we reasonably believe a referral is not genuine — including self-referral, duplicate or automated account creation, and any attempt to circumvent the limits above.
• Referral rewards are gift PineNuts and Pro access granted as a promotion. They have no monetary value, are not refundable or exchangeable, and are subject to Section 4. We may change, suspend, or end the referral program, and change any of the amounts or limits above, at any time.

6. Your Content

The Service may allow you to save words, create stories, or submit other content ("User Content"). You retain ownership of your User Content. You grant XooPark a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely to operate and improve the Service.

7. AI-Generated Content

The Service uses artificial intelligence to generate stories, illustrations, audio narration, and other learning materials. AI-generated content may occasionally contain inaccuracies. It is provided for language-learning purposes only and does not constitute professional advice. We do not guarantee specific exam results (including TOEFL, IELTS, or GRE scores).

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Copy, scrape, resell, or redistribute the Service or its content without our written permission;
• Reverse-engineer, decompile, or attempt to extract the source code of the Service;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to access accounts or data belonging to others.

9. Intellectual Property

The Service, including its software, design, dramas, stories, audio, illustrations, word collections, trademarks, and logos, is owned by XooPark LLC or its licensors and is protected by intellectual-property laws. Except as expressly permitted, no rights are granted to you.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 6, 9, 11, and 12) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XOOPARK LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR TEN U.S. DOLLARS (US$10) IF YOU HAVE PAID NOTHING.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which XooPark LLC is organized, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise.
